Gestational Surrogacy

Just like with any assisted reproductive technique, there is a possibility of multiple pregnancies such as twins or triplets especially in IVF procedures. Regular screenings and ultrasounds are essential to monitor the pregnancy and ensure the health of both the surrogate and the babies.

Legal and Emotional Considerations

While gestational surrogacy is typically less complicated in legal terms, traditional surrogacy can involve more challenges. Because the surrogate provides her own egg, she is considered a biological parent. This can lead to emotional entanglements or disputes over custody. Many intended parents choose to draft legal agreements prior to the pregnancy and, in some jurisdictions, may need to go through adoption procedures to secure full legal parenthood.

Why Is DNA Testing Important in Surrogacy ?

DNA testing helps establish biological parentage, especially in cases where legal documentation or custody rights are in question.

In Gestational Surrogacy

When the embryo is created using the intended parents’ egg and sperm, a maternity or paternity DNA test can be conducted after birth to confirm the baby’s biological link to the parents. Although the child was born through a surrogate, the DNA will match the intended parents, not the surrogate.

In Traditional Surrogacy

If the surrogate provides her egg and the father donates the sperm, the baby will share 50% of its DNA with the surrogate and 50% with the father. A paternity test can be performed to confirm the father’s biological link, while the other partner may need to proceed with legal adoption to gain guardianship.

Does the Surrogate Mother Share DNA with the Baby ?

This depends on the type of surrogacy:

  • Traditional surrogate: Yes, the baby shares 50% of its DNA with the surrogate, as she is the egg donor.
  • Gestational carrier: No, the surrogate has no genetic link to the baby. Although some cells may pass between the surrogate and the baby via the placenta, these are minimal and biologically irrelevant. They will not appear in a DNA test.
